TERMS AND CONDITIONS OF SALE
Unless otherwise expressly agreed in writing by a Director of Mega Supplies Limited all goods are sold upon the following terms and conditions. No agent or representative of Mega Supplies Ltd has any authority to vary or omit these terms and conditions. Any terms and conditions printed on the buyer’s order forms are binding only insofar as they are not at variance with these terms and conditions and they have been specially agreed to in writing by a Director of Mega Supplies Ltd.
2. ACCEPTANCE AND VARIATION OF PRICE
2.1 Quotations issued by the Mega Supplies Limited, whether verbally or in writing, do not constitute offers and are subject to Mega Supplies Limited acceptance on receipt of the buyer’s order. No contract shall be concluded until such written acceptance is given or until the Mega Supplies Limited has indicated its acceptance of the offer by making delivery or part delivery of the goods provided, Provided Always that the deliveries are made subject to these Terms and Conditions of Sales.
2.2 All prices quoted or listed by Mega Supplies Limited are based on the prices of Mega Supplies Limited’s suppliers or Mega Supplies Limited estimated costs at the time of quotation or listing and are subject to adjustment prior to despatch to cover any increase in such prices or costs, taxation or duty which might take place prior to delivery.
3.1 Mega Supplies Limited will use all reasonable endeavours to deliver at the time stated but delivery dates shall be regarded as estimates only and time shall not be of the essence. Mega Supplies Limited shall not be liable for any loss or damage whatsoever arising directly or indirectly from any failure to effect delivery within the estimate period or otherwise.
3.2 Goods shall be deemed to be delivered when they leave the premises of Mega Supplies Limited and on delivery the risk of destruction, loss or damage shall pass to the buyer.
4. RISK AND TITLE TO GOODS
The risk in the goods passes to the buyer upon delivery but property in the goods remains vested in Mega Supplies Ltd and shall only pass from Mega Supplies Limited to the buyer upon full payment being made by the buyer of all sums due from the buyer.
5. NOTIFICATION OF LOSS OR DAMAGE
The buyer shall inspect the goods upon delivery. Mega Supplies Limited must be informed within three days of delivery of goods in the event of any shortage or damage and within seven days of receipt of invoice if the goods have not been delivered otherwise the goods shall be deemed to have been accepted by the buyer as being in good order and in conformity with the contract.
Mega Supplies Limited’s aim is to provide you with quality products and the best service possible. However, if you do need to return or are unhappy with an item please contact us by email firstname.lastname@example.org or telephone 020 8681 8690 within 7 working days of receipt of the goods.
The goods must be returned in the original packaging and in unused condition. You will have to pay for the return carriage. We will then replace or refund as appropriate.
If the goods are faulty or damaged in transit, please keep all relevant documentation and packaging and contact Mega Supplies Limited within 24 hours.
Unless otherwise stated in writing payment of goods is due in full at the time of delivery.
